All artwork, images, text, and digital content created by Jill Malouf and displayed on this website are protected intellectual property. No content may be copied, reproduced, or used for commercial purposes without written permission.

Welcome to the website of Jill Malouf Fine Art (“Company,” “we,” “our,” or “us”). By accessing or using this website, purchasing artwork, commissioning custom work, or participating in any services we offer, you agree to the following Terms & Conditions. Please read them carefully.

1. Use of This Website

This website and all content on it—including images, text, graphics, and artwork—are the property of Jill Malouf. You may browse the site for noncommercial, personal use only.

You may not copy, reproduce, distribute, modify, or use any content for commercial purposes without written permission.

2. Online Purchases

All artwork sales are processed through our online shop or through direct communication with the studio.

Prices may change without notice.

We reserve the right to refuse or cancel any order if fraud, error, or misuse is suspected.

3. Shipping & Delivery / Lost or Stolen Packages

Artwork ships from Dallas, Texas unless otherwise noted.

Shipping timelines vary based on carrier, destination, and artwork size.

Once a piece leaves our studio, transit delays are outside our control. Once a package is marked as ‘delivered’ by the carrier, responsibility transfers to the buyer.

If a package arrives damaged, notify us within 48 hours with photos so we can assist with a carrier claim, but Jill Malouf Fine Art cannot replace stolen, misplaced or incorrectly delivered packages for free.

4. Local Pickup

Local pickup in Dallas is available by appointment only. Pickup must be scheduled in advance to ensure artwork is prepared and protected for transport.

5. Returns & Exchanges

All artwork sales are final.

Because each piece is original and often one‑of‑a‑kind, we do not accept returns, exchanges, or cancellations once an order is placed.

If you have questions about a piece before purchasing, we encourage you to reach out for additional photos, videos, or details.

Jill Malouf Fine Art is not responsible for damage caused by any third party handler, framer or installer.

6. Commissions

Commissioned artwork requires a non‑refundable deposit to secure your place on the studio schedule.

The remaining balance is due upon completion.

Commission deposits and payments are non‑refundable once work has begun.

7. Intellectual Property

All artwork, images, and written content on this website are protected under U.S. copyright law.

Purchasing artwork does not grant reproduction rights.

You may not scan, print, photograph for resale, or create derivative works from any piece without written permission.

No digital files are sold. No digital reproduction rights are granted.

8. Colors & Display

We make every effort to represent artwork accurately. However, colors may vary slightly due to screen settings, lighting, and device differences. These variations do not qualify as defects.

9. Third‑Party Services

We may use third‑party vendors for payment processing, shipping, or website functionality. These providers have their own terms and privacy practices. We are not responsible for their policies or performance.

10. Limitation of Liability

To the fullest extent permitted by Texas law, Jill Malouf Fine Art is not liable for any indirect, incidental, or consequential damages arising from your use of this website or purchase of artwork.

Your sole remedy for dissatisfaction with the website or services is to discontinue use.

11. Indemnification

You agree to indemnify and hold harmless Jill Malouf Fine Art, its owner, and its representatives from any claims, losses, or damages arising from your misuse of the website or violation of these Terms.

12. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas, without regard to conflict‑of‑law principles. Any disputes will be handled in the appropriate courts within Collin County, State of Texas.

13. Changes to These Terms

We may update or modify these Terms at any time. Changes take effect immediately upon posting.

Your continued use of the website constitutes acceptance of the updated Terms.

14. Payment Processing and Security

Jill Malouf Fine Art does not store credit card information and is not responsible for payment processor outages, delays or errors. Payments are processed securely through PayPal/Stripe, etc.

15. Trade orders follow separate terms. Trade discounts cannot be combined with other offers. Trade clients must provide resale certificates if applicable.

16. Typographical Errors and Pricing Accuracy

In the event of a typographical error, pricing mistake, or incorrect product information, we reserve the right to correct the error and cancel or adjust any affected orders.
